Julian Assange est « arbitrairement détenu » et doit être indemnisé selon un panel de l’ONU

Julian Assange expliquait jeudi 4 février, qu’il était prêt à « être arrêté par la police britannique » en cas d’arbitrage défavorable, mais le comité de l’ONU a annoncé vendredi qu’il considère illégale sa situation. Le fondateur de WikiLeaks vit en effet reclus dans l’ambassade équatorienne à Londres pour échapper à un mandat d’arrêt européen. Le panel de l’ONU demande à la Suède et au Royaume-Uni de l’indemniser.

« Le fondateur de WikiLeaks Julian Assange a été arbitrairement détenu par la Suède et le Royaume-Uni depuis son arrestation à Londres le 7 décembre 2010 », a indiqué le groupe de travail de l’ONU sur la détention arbitraire, dans un communiqué. Les cinq experts indépendants appellent « les autorités suédoises et britanniques » à mettre fin à sa détention et à respecter son droit à être indemnisé.

L’ONU juge la détention de Julian Assange illégale

Julian Assange a reçu le soutien d’un comité de l’ONU qui a jugé illégale sa détention jeudi. L’avocat du fondateur de Wikileaks, qui vit reclus depuis plus de trois ans à l’ambassade d’Equateur à Londres, a appelé le Royaume-Uni à le libérer.

La Suède a confirmé qu’un groupe de travail de l’ONU sur la détention arbitraire avait rendu un avis favorable au fondateur de Wikileaks, mais non contraignant pour les Etats membres, dont la teneur sera rendue publique vendredi matin à Genève.

«Si l’ONU annonce demain (vendredi) que j’ai perdu mon affaire contre le Royaume-Uni et la Suède, je sortirai de l’ambassade vendredi à midi pour être arrêté par la police britannique», avait auparavant annoncé M. Assange dans un communiqué.

«Cependant, si je l’emporte et s’il est reconnu que les parties étatiques ont agi illégalement, j’attends la restitution immédiate de mon passeport et la fin de toute nouvelle tentative de m’arrêter», avait-il ajouté, sans préciser ce qu’il ferait dans ce cas de figure.

Pas d’effet réel

L’incertitude persiste sur le bénéfice que l’Australien pourrait tirer de cet avis de l’ONU.

Le parquet suédois et les autorités britanniques se sont empressés d’assurer que cette décision ne changeait rien à la situation du militant. Elle n’a «aucune incidence formelle sur l’enquête préliminaire en cours dans le cadre de la loi suédoise», a indiqué dans un communiqué le parquet suédois, chargé de l’enquête sur des accusations de viol lancées par une Suédoise en 2010.

Ces magistrats souhaitent entendre l’Australien à l’ambassade d’Équateur à Londres, dont il n’est pas sorti depuis juin 2012. Ils ont émis contre lui un mandat d’arrêt européen.

Le gouvernement suédois, qui n’est pas juridiquement impliqué dans cette affaire, s’est borné à «constater que le groupe de travail est arrivé à une autre conclusion que les autorités judiciaires suédoises», selon un porte-parole du ministère des Affaires étrangères.

Une arrestation légale

Le gouvernement britannique a lui assuré que du fait de ce mandat d’arrêt, il était «légalement obligé d’extrader M. Assange». «M. Assange n’a jamais été détenu arbitrairement par le Royaume-Uni, il a délibérément évité une arrestation légale en choisissant de rester dans l’ambassade d’Équateur», a souligné un porte-parole.

Pour l’avocat belge de M. Assange, Christophe Marchand, le Royaume-Uni, tout comme la Suède, doit «respecter la décision du groupe de travail basée sur la convention de l’ONU sur les droits civils et politiques» et «avoir à cœur de libérer Assange».

L’Équateur, qui lui a accordé l’asile politique en août 2012, lui a garanti la poursuite d’un soutien sans faille. WikiLeaks a programmé une conférence de presse à Londres vendredi à 12H00 GMT.

Peur d’une extradition

M. Assange, qui nie le viol, refuse de se rendre en Suède de peur d’être extradé vers les États-Unis, où il pourrait se voir reprocher la publication par WikiLeaks, en 2010, de 500’000 documents classés secret défense sur l’Irak et l’Afghanistan et 250’000 communications diplomatiques.

La principale source des documents publiés, le soldat américain Bradley Manning (devenu Chelsea), a été condamné à 35 ans de prison pour espionnage.

Le site internet WikiLeaks a été fondé en 2006 dans le but de dénoncer les agissements délictueux de gouvernements ou institutions en publiant des documents confidentiels et des analyses à l’échelle mondiale.

C’est ce site qui a déposé plainte contre la Suède et la Grande-Bretagne auprès du groupe de travail de l’ONU. «La seule protection dont il bénéficie (…) est de rester dans l’enceinte de l’ambassade. La seule façon pour lui de jouir du droit d’asile est d’être en détention», lit-on dans la plainte.

1885 jours de détention

Personnage controversé, défenseur héroïque des libertés pour ses fans, égocentrique en mal d’attention pour ses détracteurs, Julian Assange vit dans une pièce de l’ambassade, située dans le quartier chic de Knightsbridge, qui fait à la fois office de chambre et de bureau et qu’il a comparée à une station spatiale.

La police londonienne a arrêté en octobre la surveillance physique de l’ambassade, dont le coût a soulevé des critiques. Les sympathisants d’Assange ont créé un site qui détaille minute par minute le nombre de jours de sa détention (1885) et son coût estimé pour les contribuables britanniques (13 millions de livres).
